Agreement to Terms

By accessing or using the Digital Architect website (digitalarchitect.dev) and services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not access the website or use our services.

Services

Digital Architect provides digital growth infrastructure and automation engineering services including but not limited to: website development, full-stack software development, SaaS platform engineering, CRM and automation systems, funnel and conversion engineering, and performance marketing management.

The specific scope, deliverables, timelines, and pricing for any engagement are defined in a separate Statement of Work (SOW) or service agreement mutually agreed upon by both parties.

Intellectual Property

Client Work Product

All custom code, designs, and deliverables created specifically for a client engagement are the intellectual property of the client upon full payment. This includes source code, design files, documentation, and databases created as part of the project scope.

Digital Architect Property

The Digital Architect website, brand assets, proprietary frameworks, methodologies, tools, and pre-existing code libraries remain the intellectual property of Digital Architect. Our general knowledge, skills, and experience gained during any engagement remain ours to use in future work.

Payment Terms

Payment terms are specified in individual service agreements. Standard terms include:

• Project-based engagements: milestone-based payments as defined in the SOW
• Retainer engagements: monthly invoicing payable within 15 days of receipt
• Discovery and assessment fees are non-refundable once work commences
• All prices are quoted in Indian Rupees (INR) unless specified otherwise
• Applicable taxes (GST) will be added to all invoices as per Indian tax law

Confidentiality

Both parties agree to maintain the confidentiality of proprietary information shared during the course of any engagement. This includes business strategies, financial data, customer information, technical architecture details, and any information explicitly marked as confidential. This obligation survives the termination of any engagement.

Limitation of Liability

Digital Architect provides services on an “as is” basis. While we strive for excellence in every engagement, we do not guarantee specific business outcomes, revenue increases, or conversion improvements. Past performance metrics referenced in case studies and marketing materials are based on specific client contexts and are not guarantees of future results.

To the maximum extent permitted by law, Digital Architect's total liability for any claim arising from our services shall not exceed the total fees paid by the client for the specific engagement giving rise to the claim.

Termination

Either party may terminate an engagement with 30 days written notice unless otherwise specified in the service agreement. Upon termination:

• The client receives all completed work product and source code
• Payment is due for all work completed up to the termination date
• Digital Architect will provide reasonable transition assistance
• Confidentiality obligations continue to apply

Website Use

By using our website, you agree not to:

• Use the website for any unlawful purpose
• Attempt to gain unauthorized access to any part of the website
• Reproduce, duplicate, or exploit any part of the website without permission
• Introduce viruses, malware, or other harmful code
• Submit false or misleading information through our contact forms

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of India. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.

Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated “Last updated” date. Continued use of our website or services after changes constitutes acceptance of the revised terms.
